The Risk Classification System

The EU AI Act establishes a four-tier, risk-based framework. Obligations scale with the level of risk an AI system poses to health, safety, and fundamental rights.

Tier 1: Unacceptable Risk (Prohibited)

Financial institutions using AI for loan underwriting, fraud detection that affects account access, or automated claims processing must comply.

Critical Infrastructure (Category 2): AI used as a safety component in the management or operation of digital infrastructure, road traffic, water supply, gas, heating, or electricity is high-risk. This increasingly includes AI-driven network operations, predictive maintenance systems, and automated grid management.

The key distinction: the Act targets AI systems that influence decisions about people or critical systems. What High-Risk AI Systems Must Do
